Complaint in Evermore Park v. Taylor Swift

On February 2, 2021, a Utah-based theme park called Evermore Park sued Taylor Swift for trademark infringement and unfair competition. Because most of the reporting on the suit doesn’t link to the Complaint, I thought I’d attach it here for the curious.

Although I do have some experience in IP law, I don’t typically practice in the field and I’ll keep my analysis to myself. But don’t expect to see Ms. Swift show up in the federal district court anytime soon.

Sidenote to reporters. Using the phrase “according to court documents” in reference to allegations in a complaint is both narrowly accurate and broadly misleading, because it tends to lead a reader to think the court has somehow endorsed the contents of the complaint (which it hasn’t).
